What drives the cost of a divorce in New York?

The single biggest factor is how much you and your spouse disagree. An uncontested divorce where you’ve already settled everything is dramatically cheaper than a contested case that runs through discovery, motions, and a trial. Other major drivers are children and custody disputes, the complexity of your finances, and whether expert valuations (of a business, pension, or real estate) are needed.

Court filing fees (everyone pays these)

New York’s mandatory court fees for a divorce total about $335 — a $210 index number fee, a $95 Request for Judicial Intervention, and a $30 note of issue fee. Add service of process (roughly $40–$75) and certified copies (about $8 each). These are separate from attorney fees and are included in the estimate above.

Typical attorney-fee ranges in Western New York

  • Uncontested: often the lowest cost — a flat or modest fee to prepare and file the agreement and judgment.
  • Mediation: usually mid-range — the mediator’s time plus independent review attorneys.
  • Collaborative: higher — each spouse has counsel and the team may include financial and child specialists, but it stays out of court.
  • Contested / litigated: the widest and highest range — driven by discovery, motions, experts, and trial time.

How fees are usually charged

Most New York family-law matters are billed hourly against a retainer (an up-front deposit), with uncontested matters sometimes handled for a flat fee.
